Hi everyone, I’m Kendra Sanchez reporting for Carlsbad News Today. We’re here with Richard Morse, a highly respected attorney at Morse Injury Law. Mr. Morse, thank you so much for joining us today.
The Importance of Negotiation
Richard, we often hear about the legal complexities involved in car accident cases. Could you shed some light on the negotiation and settlement process?
Certainly, Kendra. The negotiation phase is crucial in many personal injury cases. Ordinarily, after filing a claim and gathering all necessary evidence, we aim to negotiate a fair settlement with the insurance company representing the at-fault party. This involves presenting them with a comprehensive understanding of our client’s damages, including medical expenses, lost wages, pain and suffering, and other relevant losses.
Negotiations can involve back-and-forth discussions, where we advocate for our client’s best interests while considering the insurance company’s perspective. The goal is to reach a mutually acceptable agreement that compensates our client fairly for their injuries and losses.
Challenges in Negotiation
Are there ever challenges or roadblocks encountered during this negotiation process?
Indeed, Kendra. Negotiations can sometimes be complex and protracted. Insurance companies are businesses, and they often aim to minimize payouts. Consequently, they may initially offer a settlement that is significantly lower than what we believe our client deserves.
I recall one case where the insurance company initially offered a paltry sum for a client who suffered a severe back injury in a car accident. It required extensive negotiation and the presentation of compelling medical evidence to convince them to offer a fair settlement.
It’s important for our clients to understand that we are relentless advocates on their behalf. We will not hesitate to take a case to trial if we believe a fair settlement cannot be reached through negotiation.
Studies by the Insurance Research Council have shown that injured parties who are represented by attorneys receive settlements that are, on average, 3.5 times higher than those who represent themselves.
