Next, valid creditor claims are paid from the estate’s assets. Ordinarily, this is done according to a priority system established by law. Secured debts, like mortgages or car loans, typically take precedence over unsecured debts such as credit card bills.
Along with paying off debts, we also need to address any tax obligations owed by the estate. This can include federal and state estate taxes, as well as income taxes for the period leading up to the decedent’s passing.
It’s important to remember that failing to properly handle these financial matters can result in significant complications and potential liability for the executor or administrator of the estate.

Well, I recall one instance where a family was unaware of a substantial loan their loved one had taken out. It turned out to be a personal loan from a friend, and there wasn’t any formal documentation. The friend came forward after the estate was already in the process of being settled, which caused quite a bit of stress for the family.
Ultimately, we were able to work it out amicably, but it highlighted the importance of thorough record-keeping and open communication about financial matters within families.
