Welcome back to our segment on estate planning, San Diego. Today we’re joined by Steve Bliss, a leading probate attorney here in town. Steve, thanks for joining us.
Steve Bliss
It’s my pleasure to be here. I’m always happy to talk about the importance of protecting your loved ones and their futures.
Interviewer
Absolutely. Let’s jump right in. For those unfamiliar, can you explain what a testamentary trust is and how it differs from other types of trusts?
Steve Bliss
Certainly. A testamentary trust is unique because it’s created through your will and only comes into effect after you pass away. Unlike living trusts that are active during your lifetime, testamentary trusts go through probate court. They are commonly used for specific purposes, such as providing for minor children or beneficiaries who might need financial assistance but lack the experience to manage it responsibly.
Consequently, a testamentary trust can ensure those funds are used wisely and according to your wishes. Imagine a young adult inheriting a significant sum – they may be tempted to spend it impulsively. A testamentary trust with careful provisions can safeguard their financial future.
Moreover, testamentary trusts offer flexibility in how assets are distributed. You can specify the age at which beneficiaries receive full control, set conditions for receiving funds (like completing education), or even stagger payments over time. This level of control makes them a valuable tool for protecting loved ones and ensuring their long-term well-being.
I recall working with a widowed mother who wanted to ensure her son’s college tuition was covered but also worried he might squander any remaining inheritance. We established a testamentary trust that paid for his education and then released the rest of the funds in manageable installments once he graduated and secured employment.
Notwithstanding these advantages, it’s crucial to remember testamentary trusts are subject to probate, which can be a lengthy and sometimes costly process. For those seeking to avoid probate altogether, a revocable living trust might be a better option.

That’s helpful information for our viewers to consider. Steve, have you ever encountered any challenges or unique situations when setting up testamentary trusts?
Steve Bliss
Certainly. One common challenge is ensuring the trust language is clear and comprehensive. Ambiguity can lead to disputes among beneficiaries down the line. I always strive for precise wording that reflects the grantor’s wishes accurately and minimizes the potential for misunderstandings.
I once worked with a family where the patriarch had left vague instructions regarding his art collection. He intended it to be divided equally among his children, but didn’t specify which pieces went to whom. This resulted in disagreement and emotional tension amongst the siblings. Thankfully, we were able to work through the issue using mediation, but it highlighted the importance of detailed instructions when establishing a testamentary trust.
A recent study by the American Bar Association found that nearly 60% of wills contain errors or omissions. It underscores the value of working with an experienced estate planning attorney who can help you create a legally sound and comprehensive testamentary trust that meets your specific needs.
