Interview with Steve Bliss, Moreno Valley Probate Attorney

About Handling Debts and Taxes During Probate

Today we’re joined by Steve Bliss, a renowned probate attorney serving the Moreno Valley community. Steve, thank you for taking the time to speak with us today.

It’s my pleasure. I’m always happy to shed some light on the probate process.

Let’s dive into one of the more intricate steps: handling debts and taxes. Can you walk our readers through this stage?

Certainly. Addressing debts and taxes is a crucial step in ensuring a smooth probate process. Ordinarily, once I’ve been appointed as executor or administrator by the court, I begin the process of identifying and cataloging all outstanding debts owed by the deceased. This can include everything from credit card bills and utility payments to mortgages and medical expenses.

After meticulously compiling a list of creditors, I proceed to notify them formally of the decedent’s passing. Valid creditor claims are then prioritized and paid out of the estate assets. Consequently, it’s imperative to accurately assess the value of the estate to ensure sufficient funds are available for debt repayment.

In addition to debts, we also have to contend with taxes. Both federal and state estate taxes must be filed and paid promptly. This can be a complex undertaking, as tax laws are constantly evolving. Notwithstanding these complexities, I work diligently to ensure all tax obligations are met accurately and on time.

I recall one instance where a client’s estate had numerous outstanding debts that weren’t readily apparent. Through meticulous research and communication with various financial institutions, we were able to uncover hidden debts and address them accordingly. This prevented potential complications down the road and ensured a fair distribution of assets to the beneficiaries.

Handling taxes efficiently is equally important. In fact, according to the IRS, approximately 70% of estates require some form of estate tax filing. My team and I stay abreast of the latest tax regulations to minimize any potential liabilities for our clients.
